Recovering a debt

It may be enough for us simply to write a letter requesting payment on your behalf, or it may be necessary for more formal action to be taken.  This could include service of a statutory demand (leading to personal bankruptcy or company liquidation) or the issue of court proceedings.

Debt recovery or collection is a form of litigation.

A debt will usually arise as a result of a party’s failure to pay as required, for goods supplied or a service provided.

Interest

If you are an individual, you may be able to claim interest on any amount owed to you even if this was not originally agreed. This also applies if you are a business and your terms of business do not provide for interest on late payment.  And if you are a business owed money by another business or the public sector, you may be able to claim interest under the Late Payment of Commercial Debts (Interest) Act 1998 at a higher rate.

Disputing a debt

It could be that you are being pursued for a debt you do not believe is owed.  This might arise where goods supplied were not of a satisfactory quality or a service provided was not carried out as agreed or to a reasonable standard.
